By accessing or using Depthify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

2. Description of Service

Depthify is an AI-powered image editing service that runs entirely in your web browser. The Service provides tools for:

• AI-powered depth detection and effects
• Text placement behind people in images
• Multi-object segmentation
• Background removal and replacement
• Layer-based image editing

All image processing occurs locally in your browser. Your images are not uploaded to our servers unless you explicitly choose to export them.

3. User Accounts

3.1 Account Creation

You may create an account to access additional features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Requirements

• You must be at least 13 years old to use the Service
• You must provide accurate and complete information when creating an account
• You must not create multiple accounts to circumvent usage limits
• You must not share your account credentials with others

4. Subscription Plans and Payment

4.1 Free Plan

The Free plan provides limited access to the Service, including:

• 3 anonymous exports
• 7 exports per day for authenticated users
• Watermarked exports
• 1 text layer
• 1080p maximum resolution

4.2 Pro Plan

The Pro plan provides unlimited access to all features, including:

• Unlimited exports
• No watermarks
• Unlimited text layers
• 4K resolution support
• Priority support

4.3 Payment Terms

• Subscriptions are billed monthly or annually in advance
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days' notice
• Failed payments may result in suspension of your account

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You will continue to have access to Pro features until the end of the billing period.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload or process images containing illegal, harmful, or offensive content
• Infringe on the intellectual property rights of others
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated systems to access the Service without permission
• Interfere with or disrupt the Service or servers
• Create accounts using automated means or false information
• Share your account credentials or allow others to use your account
• Use the Service to create content that violates others' rights

6. Intellectual Property

6.1 Your Content

You retain all rights to images you upload and edit using the Service. You are solely responsible for ensuring you have the right to use and edit any images you upload.

6.2 Our Content

The Service, including its design, features, and functionality, is owned by Depthify and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the Service without our written permission.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. AI processing results may vary and are not guaranteed to be accurate or suitable for your intended use.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEPTHIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Depthify and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

11. Governing Law
